These Terms and Conditions (“Terms”) govern your access to and use of Consistly (the “Service”), provided by Consistly.ai (“we,” “us,” or “our”). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.

1. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) and able to form a binding contract. If you're using Consistly on behalf of a company or organization, you confirm you have authority to bind that entity to these Terms.
2. Your Account
- You are responsible for the activity that happens under your account.
- Keep your sign-in credentials confidential. Notify us promptly at [email protected] if you suspect unauthorized access.
- You agree to provide accurate information when signing up and to keep it current.
3. Acceptable Use
While using Consistly you agree NOT to:
- Violate any applicable law or regulation, or any third party's rights.
- Generate or publish content that is unlawful, defamatory, harassing, hateful, or promotes violence.
- Use the Service to spam, scrape, or otherwise abuse LinkedIn or any third-party platform — including violating LinkedIn's Terms of Service or API policies.
- Reverse-engineer, decompile, or attempt to extract source code, models, or data from the Service except as permitted by law.
- Resell, sublicense, or share your account or AI usage credits without our written permission.
- Interfere with the Service's operation — e.g. transmit malware, probe for vulnerabilities outside an authorized program, or overwhelm our infrastructure.
4. Your Content
You retain ownership of the post drafts, ideas, strategy documents, carousels, and any other content you create or upload through the Service (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, store, process, and display Your Content solely so we can operate, secure, and improve the Service for you.
You are responsible for Your Content and for ensuring you have the rights to use any material you upload (for example, images, brand assets, or quotes).
5. AI-Generated Output
Consistly uses third-party AI models to help you generate post drafts, ideas, and images. AI output can contain inaccuracies, biases, or content that resembles existing material — you are responsible for reviewing AI output before publishing. We do not warrant that AI output is original, accurate, or fit for any particular purpose.
6. LinkedIn Connection
When you connect your LinkedIn account, you authorize Consistly to act on your behalf only for the actions you initiate (publishing posts, fetching your recent content, etc.). You can disconnect at any time from Settings. Your use of LinkedIn through Consistly is also governed by LinkedIn's own terms.
7. Plans, Trials, and Payments
- Card payments are processed directly by Stripe, a PCI-DSS Level 1 certified service provider. We do not store your full card number, CVC, or expiry.
- Paid plans are billed through Stripe. Pricing, billing cycle, and the features included in each plan are listed on our pricing page and may change with notice.
- Free trials, if offered, automatically convert to paid subscriptions at the end of the trial unless cancelled before the trial ends.
- You can cancel anytime. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued except where required by law.
- We may change pricing prospectively. Existing subscribers will be notified before the change takes effect on their plan.
8. Suspension and Termination
We may suspend or terminate your access to the Service if you breach these Terms, misuse the Service, or if continued provision would expose us to legal risk. You may close your account at any time from Settings. On termination, your right to use the Service ends immediately; certain data may be retained as described in our Privacy Policy.
9. Disclaimer
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI output will meet your expectations.
10. Limitation of Liability
To the maximum extent allowed by law, neither Consistly nor its providers will be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $100.
11. Changes to These Terms
We may update these Terms from time to time. If a change is material we'll notify you (e.g. by email or in-product notice) before it takes effect. Continued use of the Service after the change means you accept the updated Terms.
12. Governing Law and Disputes
These Terms are governed by the laws of the jurisdiction in which Consistly operates its business, without regard to conflict-of-law principles. Where mandatory consumer rights in your country provide stronger protections, those rights apply.
